  2. One evening after attending the theater
  3. two gentlemen were walking down the
  4. street when they observed a well
  5. dressed, attractive young lady walking
  6. just ahead of them. One turned to the 
  7. other and said, "I'd give 50 bucks to
  8. spend the night with that woman." To 
  9. their suprise, the woman turned and 
  10. said, "I'll take you up on that." She
  11. had a neat appearance and a pleasent
  12. voice, so after bidding his
  13. friend goodnight the man accompanied
  14. the lady to her apartment, where they
  15. immidiately went to bed.

  17.   The following morning the man 
  18. presented her with 25 dollars as he 
  19. prepared to leave. She demanded the 
  20. rest of the money stating, "If you
  21. don't give me the other 25 I'll sue 
  22. you for it." He laughed, saying, 
  23. "I'd like to see you get it on these
  24. grounds."

  26.   The next day he was suprised when he
  27. was served with a summons ordering his
  28. presence in court as defendant...
  29.  
  30. He hurried to his lawyer and explained
  31. the details of the case. His lawyer 
  32. said, "She can't possibly get a
  33. judgment against you on such ground,but
  34. it will be interesting to see how her 
  35. case will be presented."
  36.  
  37.   After the usual preliminaries, the
  38. lady's lawyer addressed the court
  39. as follows:
  40.  
  41.   "Your Honor, my client is the owner
  42. of a piece of property, a garden spot
  43. surrounded by a profuse growth of
  44. shrubbery, which property she agreed to
  45. rent to the defendant for a specified
  46. length of time for the sum of  $50.
  47. The defendant took possesion of the 
  48. property, used it extensively for the
  49. purpose for which it was rented, but 
  50. upon evacuating the premises he paid 
  51. only $25. The rent is not excessive 
  52. since it was restricted property, and 
  53. we ask judgment to be granted against
  54. the defendant to assure payment of the
  55. balance."
  56.  
  57.   The defendant's lawyer was impressed
  58. and amused at the way the case had been
  59. presented. His defense was therefore
  60. somewhat altered from what he had
  61. planned.....
  62.  
  63. This is what he said:
  64.  
  65.   "Your Honor, my client agrees the 
  66. young lady has a fine piece of 
  67. property, for a degree of pleasure was
  68. derived from the transaction. However
  69. my client found a well on the property,
  70. around which he placed his own stones;
  71. sunk a shaft and erected a pump, all
  72. labour being personally performed by 
  73. him. We claim these improvements to the
  74. property are sufficient to offset the 
  75. unpaid balance, and that the plaintiff
  76. was adequately compensated for the 
  77. rental of the said property. We 
  78. therefore ask that the judgment not be 
  79. granted."

  81.  The young lady's lawyer's comeback was
  82. like this..
  83.  
  84. "Your Honor, my client agrees that the
  85. defendant did find a well on the 
  86. property, and he did make improvements
  87. such as described by my opponent, 
  88. however, had the defendant not known the
  89. well existed, he would have never have 
  90. rented the property; also, on evacuating
  91. the premises, the defendant moved the
  92. stones, pulled out the shaft and took
  93. the pump with him. In so doing he not
  94. only dragged his equipment through the
  95. shrubbery, but left the hole much large
  96. than it was prior to his occupancy,
  97. making it easily accessible to little
  98. children. We therefore ask judgment be
  99. granted."
